At Douglas Hoskins Legal, our dedicated Family Lawyers provide personalised legal advice, specifically tailored to help you achieve a positive outcome. • Our experienced team recognises the emotional and practical challenges involved in navigating parenting disputes. Our Family Law team is committed to supporting our clients through what can be an overwhelming and emotional process, focussing on the individual needs of your children and ensuring that their best interests and wellbeing are prioritised. We offer expert advice in negotiating living and caring arrangements, parenting plans and parenting Orders.

  • Our team can assist with preparation of Application for Consent Orders to be filed with the Federal Circuit and Family Court of Australia to legally document your agreement with respect to property and/or parenting matters.

Common uses for Application for Consent Orders include:-

    • Parenting arrangements
For example: Who a child/children lives with and spends time with, holiday schedules, etc.

    • Property and financial settlement
For example: How property and superannuation will be divided between the parties and in what time frame.

    The process involved:-

    • Reach an agreement
The parties negotiate and agree on the terms (sometimes with lawyers or mediators).

    • Draft the application
You complete and file an Application for Consent Orders along with the actual proposed Consent Orders (these are the orders you want the court to approve).

    • File with the Family Court
This is done through the Federal Circuit and Family Court of Australia (FCFCOA) online portal.

    • Court approval
A Registrar reviews the application. If satisfied that the agreement is just and equitable (for financial matters) and in the best interests of any children involved (for parenting matters), the court will approve the Orders and they will become legally binding on the parties.

    The benefits:-

    • Legally binding without the need for a trial

    • Faster and cheaper than litigation

    • Greater control over the outcome

    • Provides certainty and enforceability

  • Our team can assist with filing an Application for Divorce. An Application for Divorce is a legal request submitted to the Federal Circuit and Family Court of Australia asking to legally end a marriage.

    You can apply:

    • Individually (a sole application) or

    • Together with your spouse (a joint application)
